United Terra Technologies (the “Company”) warrants its baton products to be free from manufacturer’s defects in materials and workmanship under normal use for a period of 2 years from the date of purchase. If you believe this product has any defect in materials and/or workmanship, cease use immediately and contact Customer Support. If a product proves to be defective in material or workmanship, we will repair or replace the product, at our discretion, free of charge. This warranty covers replacement against breaking under normal field use. This warranty does not apply to a baton that has been subjected to (a) use, neglect or treatment outside of product instructions, or (b) not maintained or stored in accordance with product specifications.

This is a LIMITED WARRANTY and is the sole exclusive warranty of this product by the Company. This LIMITED WARRANTY applies only where the product has been properly maintained and stored and have been used in accordance with the available instructions and has not been subjected to misuse or negligence.

Misuse, whether intentional, or neglect (accidental or otherwise) void the LIMITED WARRANTY and any other warranty expressed or implied arising under this document. Any baton damage by misuse or failure to follow instructions will be repaired at a reasonable charge if returned by owner to United Terra Technologies.

THE COMPANY MAKES NO OTHER WARRANTEES EXPRESSED, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANABILITY.

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, ANTICIPATED OR LOST PROFITS, INCIDENTAL DAMAGES, LOSS OF TIME OR OTHER INDIRECT LOSSES OR EXPENSES THAT ARISE OUT OF THE ANY CAUSE RELATING TO THE PRODUCT, REGARLESS OF THE  ACTION, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE AND REGARDLESS OF WHETHER THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT APPLICABLE LAWS PROSCRIBE THESE LIMIATIONS OR WAIVERS, IN WHOLE OR IN PART, THEN THIS WAIVER SHALL BE ENFORCED TO THE MAXIMUM EXTENT OTHERWISE PERMITTED BY APPLICABLE.
